CERRO GORDO STATE BANK OF CLEAR LAKE, Defendant, et al., Appellant No. 39837 Supreme Court of Iowa, Des Moines April 14, 1930 Appeal from Cerro Gordo District Court.--C. H. KELLEY, Judge. Suit in equity, tried with a petition for new trial in mortgage foreclosure suit, to determine the proportion of the mortgage indebtedness which should be borne by the separate tracts of land covered by the mortgage, but belonging to different owners, and to establish payment and redemption accordingly. The plaintiff is James P. Hansen, as guardian for his two minor children, James P. Hansen, Jr., and Erna Hansen. The land in controversy, 160 acres, was owned by Anna Hansen wife of plaintiff and mother of his wards. The mortgage was given by Anna Hansen and plaintiff, James P. Hansen, November 11, 1920, to the Northwestern Mutual Life Insurance Company. Anna Hansen died in April, 1922. The mortgagee, the Northwestern Life Insurance Company, commenced foreclosure of the mortgage December 24, 1924, the result of which was a special execution sale, July 18, 1925, of the mortgaged premises, consisting of the 160 acres in question, owned in severalty by Anna Hansen, and the 80 acres owned by James P Hansen individually. The two tracts were sold en masse. The defendants were the Cerro Gordo State Bank and Mabel Meibergen. They were judgment creditors of James P. Hansen. The bank, on April 15, 1926, made creditor's redemption of both tracts. The appellant, Mabel Meibergen, thereupon made subsequent creditor's redemption of both tracts. On June 3, 1926, plaintiff, having conveyed his one third to his children and wards, paid into the clerk's office the full amount represented by the sheriff's certificate of sale and made affidavit for redemption and determination of the amount required to be paid in behalf of his wards, pursuant to Section 11792, Code, 1924. On July 17, 1926, the present petition, and on the same date, petition for new trial in the foreclosure suit in behalf of the minors, were filed. The two proceedings were tried together. The court entered dismissal as to defendant Cerro Gordo State Bank, and sustained the suit as to defendant Mabel Meibergen, who appeals. Affirmed. Ira W. Jones, R. F.
